In this podcast, Nick Walker, of LexisNexis Risk Solutions, speaks about the connected car use cases and the smashHit project. Nick discusses how data streaming from connected cars can be used to reward the driver with safer driving, creating a model based on transparency and merit to reward the driver and in turn providing insurance products based on information from the connected vehicles. Pay per mile for example or pay how you drive.

SmashHit is an EU funded project set up to devise ways to increase the willingness of consumers (Data Owners) to allow (through consent) companies to use their personal data for the provision of personalized services. We have identified you as a company/organization that possibly uses or processes personal data in order to provide personalized services to the consumer. Although you may not interact directly with the Data Owner in terms of obtaining consent from them.

Personal data is any information that relates to an identified or identifiable living individual. Pieces of information, which collected together can lead to the identification of a particular person, are also considered to be personal data.

We would greatly appreciate your feedback to the following survey questions to help us to better understand the market. Thank you for taking the time to give us your valuable inputs!

Disclaimer: This project has received funding from the European Union’s Horizon 2020 research and innovation programme under grant agreement No 871477

Consent remains one of six lawful bases to process personal data, as listed in Article 6 of the GDPR. When initiating activities that involve processing of personal data, a controller must always take time to consider what would be the appropriate lawful ground for the envisaged processing. Generally, consent can only be an appropriate lawful basis if a data subject is offered control and is offered a genuine choice with regard to accepting or declining the terms offered or declining them without detriment. When asking for consent, a controller has the duty to assess whether it will meet all the requirements to obtain valid consent. If obtained in full compliance with the GDPR, consent is a tool that gives data subjects control over whether or not personal data concerning them will be processed. If not, the data subject’s control becomes illusory and consent will be an invalid basis for processing, rendering the processing activity unlawful. [1]

Businesses sometimes assume that the user’s silence means consent to data processing, or they hide a request for consent in long, legalistic, terms and conditions — that nobody reads. The user will need to give an affirmative consent before his/her data can be used by a business. Silence is no consent.Often businesses explain their privacy policies in lengthy and complicated terms. Privacy policies need to be written in a clear, straightforward language. Sometimes businesses collect and process personal data for different purposes than for the reason initially announced without informing the user about it. Businesses will be able to collect and process data only for a well-defined purpose. They will have to inform the user about new purposes for processing. [2]

The overall objective of smashHit is to assure trusted and secure sharing of data streams from personal and industrial platforms needed for sectorial and cross-sectorial services, by establishing a framework for automatic processing of data owner consent and automatic contracting, as well as joint privacy and security preserving mechanisms. Focusing on platforms with data streams coming from usage of (mass) products with cyber physical features (Cyber Physical Products – CPP) and combining them with data from other personal and industrial data platforms, (insurance data platforms, traffic data platforms).

The project will use several industrial and personal data platforms populated with data streaming from CPP and other sources as a reference for development of the Framework.

There is a short-term challenge for the Data Industry to look for an interoperable data-sharing framework to enforce and manage multi-platform agreements for exchanging data whilst protecting and assuring compliance with GDPR, Privacy and Security Policy, enforcement rules of individual data providers, national data privacy and protection rules and EU-legal directives and legislations surrounding personal and industrial data generation, storage and sharing.

In this podcast we spoke to Victor Corral, the Innovation project Manager of ATOS about some of the technical aspects of consent and some of the challenges that the smashHit project faces.

WHAT IS SMASHHIT

smashHIT & the Data Economy

The EU Data Market is forecasted to reach 85 billion euro with accumulative growth of 7% between 2020 and 2025 as European Enterprises accelerate their Digital Transformation.

What is smashHIT?

The smashHIT project aims to overcome obstacles in the rapidly growing Data Economy which is characterised by all sorts of various diverse technical designs and proprietary implementations. This is not an ideal situation because what this does in turn is it locks down various business opportunities due to all the inconsistent consent and legal rules among all the different data-sharing platforms operators and bodies involved. In turn this restricts innovation and results in lost opportunities. The smashHit project is formed by a consortium of nine organisations drawn from analytics, data security, car manufacturing, smart city infrastructure and academia working collaboratively to deliver the benefits of shared connectivity to millions of consumers.

Objective

The objective of smashHIT is to assure a trusted and secure sharing of data streams from both personal and industrial platforms which are needed to build sectoral and cross-sectoral services. The project will offer a new framework for effective sharing and brokerage of data streaming over diverse platforms, both personal and industrial and allowing for efficient generation of services by combining the data. The main focus in smashHIT will be on platforms with data streams coming from the usage of products embedded within systems in combination with data from personal and industrial platforms such as:

  • Insurance Data platforms
  • Traffic Data platforms
  • Smart City Data

A Smart Data Dispatcher will assure common consent over data shared using semantic models of consent and legal rules. The new tools include traceability of use of data, data fingerprinting and automatic contracting among the data owners, data providers, service providers and volumes on data streaming from the usage of mass products with cyber physical features (e.g. vehicles). These data streams offer new opportunities to build innovative services, but their combination with other personal and industrial data is subject to complex ownership and consent aspects, as the data streaming from these products belong to persons or organizations who are owners or users of the products. The project will strongly use the relation to the Big Data Value Association (www.bdva.eu)

The vision of smashHit is to overcome obstacles in the rapidly growing Data Economy which is characterized by heterogeneous technical designs and proprietary implementations, locking business opportunities due to the inconsistent consent and legal rules among different data-sharing platforms actors and operators.

The smashHit framework will provide methods and tools, such as Smart Data Dispatcher, to assure common consent over data shared using semantic models of consent and legal rules. The new tools include traceability of use of data, data fingerprinting and automatic contracting among the data owners, data providers, service providers and users.

INDUSTRIAL LEADERSHIP – Leadership in enabling and industrial technologies – Information and Communication Technologies (ICT)

In line with the flagship initiative ‘Digital Agenda for Europe’ (4), the specific objective of ICT research and innovation (R&I) is to enable Europe to support, develop and exploit the opportunities brought by ICT progress for the benefits of its citizens, businesses and scientific communities.

As the world’s largest economy and representing the largest share of the world’s ICT market, worth more than EUR 2 600 billion (EUR 2 600 000 000 000) in 2011, Europe should have legitimate ambitions for its businesses, governments, research and development centres and universities to lead European and global developments in ICT, to grow new business, and to invest more in ICT innovations.
